Please acquaint yourself with the terms and conditions of this agreement (the "Agreement") under which our services and products are offered to you. If you visit the Site, you agree to be bound by these terms and conditions as in effect at the time of your visit. If you do not agree to any provision of this Agreement, please do not access the Site. We reserve the right to change, update or revise any provision of this Agreement at any time without notice. Please check this Agreement regularly for changes. Unless otherwise specified, the Site and the Contents thereof are displayed solely for the purpose of promoting and selling FIEL products.

Disclaimer of Representations and Warranties

All products, services and information made available on or through the Site are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Subject to the foregoing, FIEL disclaims all implied warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose, and all express warranties except those explicitly made in this statement of legal terms. FIEL makes no representation that the information contained on the Site, your results in using the Site or the service itself will be accurate, valid, reliable or available or that it does not violate or infringe the rights of any third party. Waiver of Liabilities

You agree that, except as otherwise provided under applicable laws, neither FIEL nor its affiliates, nor the directors, officers, employees, agents, contractors, successors or assigns of each, shall be liable for any damages whatsoever arising out of or related to the use of the Site or any other web site linked to the Site. This waiver of liability applies to direct, indirect, consequential, special, punitive or other damages you or others may suffer, as well as damages for lost profits, business interruption or the loss of data or information, even if FIEL is notified in advance of the potential for any such damages. To the extent certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages, only those specific provisions shall be held invalid and will be severed from the remainder of the Agreement. The remaining terms shall be enforceable.

Unlawful Conduct

You agree you are prohibited from posting or transmitting to the Site any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material, or any other material that could give rise to any civil or criminal liability under the law. Any attempt to damage the Site is a violation of the law. FIEL reserves the right to seek all remedies available at law and in equity for violations of these terms and conditions, including the right to block access from a particular internet address to the Site. FIEL and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion. This Agreement shall be construed in accordance with the laws of the State of California, without regard to any conflict of law provision. Any dispute arising under this Agreement shall be governed by the laws of the State of California and shall be initially subject to mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. Any unresolved controversy or claim arising from or relating to this Agreement or breach thereof that are not settled by mediation shall be resolved exclusively by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. All decisions of the arbitrator will be final, binding, and conclusive on all parties. The arbitrator (if permitted under applicable law) or the court may issue a writ of execution to enforce the arbitrator's decision. This Agreement constitutes the entire understanding between FIEL, FIELshoes. com and its users. Please review our other policies, such as our Privacy Policy, posted on the Site. We reserve the right to make changes to the Site, policies, and this Terms and Conditions Agreement at any time and in our sole discretion; therefore, you should review those policies, terms, and conditions each time you visit the Site. Your continued use of the Site after we make any such changes constitutes your binding acceptance of those changes. If any of the terms or conditions herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.

FIEL is committed to protecting your privacy. We take your right to privacy seriously and we want you to feel comfortable using the Site. When you place an order, we need you to provide certain information including your name, phone number, email address, mailing address, billing address, and credit card number with expiration date (individually and collectively, the "Information"). The Information will be used to process and fulfill your order and to notify you of your order status. You cannot opt out of administrative emails such as order confirmation messages. The checkout process requires a valid name, phone number, email address, mailing address, billing address, credit card number and credit card expiration date. If you create an account with us, you may edit the Information in the account configuration area. If you create an account with us, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Information provided to these entities is not for marketing purposes. Please be aware that no data transmission over the Internet is 100% secure. While we take steps to protect the Information, we cannot guarantee the security of any information you transmit to us and you do so at your own risk. By using the Site, you consent to the collection and use of Information by FIEL. While this Privacy Policy states our standards for maintenance of your personal data and we will make efforts to meet them, we are not in a position to guarantee these standards. All software used on this site is the property of FIEL or its software suppliers and is protected by United States and international copyright laws. ORDER CHANGES or CANCELLATIONS You may cancel your order via email to support@FIELshoes.com to the time the order is processed and shipped. If the order has been processed and shipped, you cannot cancel your order; however, you can return unworn merchandise for an online credit. In these instances, you are responsible for shipping costs to and from FIEL. RETURN POLICY We appreciate your business and hope that you are happy with your purchase from FIEL. Please review our return policy carefully. We reserve the right to refuse a return or exchange request if it does not comply with this policy.

We accept returns for online credit and exchanges on items that are in their original condition and have not been worn or altered. Please note that refunds are not permitted.
When trying on merchandise for size, please take care not to damage the insole or sole, as we will not be able to accept merchandise as unworn if the insole or sole show wear, which is determined at FIEL's sole discretion.
Return and exchange requests must be made via email to returns@FIELshoes.com within 3 days of receipt of the merchandise. If the request meets our return criteria, you will be issued a Return Authorization (RA) number, via email. We must receive the merchandise for return no later than 7 days after the RA number has been issued.
Merchandise must remain in its original packaging, i.e., shoes must remain in their original shoebox and include their original shoe bag.
Purchase of merchandise at a discounted price on the Site a.k.a. "on sale" ("Sale Merchandise") is FINAL; there are no returns, no exchanges, and no exceptions on Sale Merchandise.
We do not refund shipping and handling charges unless we have made an error in your order.
In the event the contents of your package were damaged in transit, please contact the carrier. You must keep all original packaging for inspection by the carrier.
We reserve the right to deny a return or exchange if it does not meet our return policy criteria.

If you need to return or exchange your order, please follow the instructions below.

Request a Return Authorization (RA) number via email at returns@FIELshoes.com within 3 days of receiving your merchandise.
Download and print the Return Authorization Form. Include the fully completed Return Authorization Form with your return. The Return Authorization Form includes the RA number, the date the order was received, the billing and shipping contact information, the quantity number of each item being returned, the item name, the item size, the single item price, the total price of the returned items, and a brief description of the reason for the return.
Once you receive your RA number via email, repackage your return securely in a box comparable to the one in which you received your order and include (I) the Return Authorization Form, (II) the merchandise in its original packaging, and (III) a copy of your receipt.
We must receive the merchandise for return no later than seven (7) days after the RA number has been issued.
Please retain a copy of your receipt for your records.
FIEL is not responsible for any shipping charges that occur from your return. All return shipping charges must be prepaid. We will not accept CODs or third-party billing for returned merchandise.
For your protection, we recommend that you use USPS, UPS, FedEx, or DHL and obtain a tracking number for your return. We are not responsible for items in transit. Please keep the tracking number for the package you are returning to ensure that the package is returned to the warehouse.

PRODUCT DESCRIPTIONS, PRICING, and AVAILABILITY

We truly appreciate your business and we hope that you have a fantastic experience shopping on the Site. We attempt to describe the products offered on the Site as accurately as possible. However, FIEL does not warrant that product descriptions or other content of the Site are accurate, complete, reliable, current, error-free, available or that they do not violate or infringe the rights of any third party. As the actual colors you see depend on the particular technical specifications and settings of your computer and its display and your eyesight, FIEL cannot guarantee that your monitor's display of any color will be accurate. If a product offered by FIEL on the Site and purchased by you is not as described, your sole remedy is to return it in unused condition for a FIEL credit. In the event that a product or service is listed at an incorrect price due to typographical error, FIEL shall have the right to refuse or cancel any orders placed for the product or service listed at the incorrect price. FIEL cannot always guarantee the availability of all products. We may cancel your order or part of your order if an item is sold out and no longer available. If you have ordered an item that is no longer available or if an item will be delayed in shipping, we will notify you of the situation via email. In the event of partial orders, FIEL will ship the items in stock and remove the out of stock items from your order. We do not charge your credit card until your order is ready to be shipped and, of course, we do not bill you for items that are not available.

SHIPPING

FIEL ships all orders using Federal Express (FedEx®). FedEx bases the shipping cost on several factors, including the total price of the items, the weight of the package, and its destination. To determine the shipping cost, please add your selected item(s) to your cart and proceed to checkout. You will be able to view the shipping options and costs during the checkout process. Your transit time will depend on the level of service you select from FedEx and your destination. Transit times may increase if your order is being shipped to a rural address or during the holiday seasons. Please note that while FedEx is usually very fast and accurate, the arrival time is not guaranteed. Please allow up to five (5) business days for FIEL to fully process your order. We pride ourselves on shipping orders quickly and we aim to process all orders within two (2) business days. We process orders Monday through Friday. We do not ship to Post Office (PO) boxes. If your order is delayed, FIEL will send you an email to notify you of the delay and FIEL will ship your order within five (5) business days of the notification email. If FIEL cannot ship your order within five (5) business days after such email, you will be notified that your oder has been cancelled via email and FIEL will not charge your credit card. All products purchased from the Site are made pursuant to a shipment contract. This means that the risk of loss and title for such products pass to you upon FIEL's delivery to the carrier.
